With NGT issues coming to an end, thousands of Noida Home Buyers are eagerly awaiting possession of their apartments. Noida Authority promises to offer Occupancy Certificate in a week and Noida Stamp department promises a smooth registration process.
Before you go ahead with the registration of your apartment, it is recommended that you understand the process and charges involved.
Sub-lease / Registration of apartments in Noida
Once your apartment is ready and you have made full and final payment to developer, it’s mandatory for them to get your flat sub-leased from Noida Authority. This process involves following charges:
- Stamp duty: This is the value of stamp paper that is levied by Uttar Pradesh stamp department.
- Sublease charges: Authorities owns the land in Noida / Greater Noida region, so they also impose a fee of 10100/- from home buyers.
- Sublease facilitation or Admin charges: 10 to 25 thousand rupees charged by city developers as Admin / Lawyer’s fee.
Admin Charges / Lawyer Charges
While it should be buyer’s choice to avail services of builder or his lawyers in the process of apartment registration, Noida / Greater Noida builders have coerced home buyers to pay hefty amount for the services. Builder insist on getting the registry done through his office and ensure that home buyers pay this amount upfront. In some cases builders are asking for stamp money in advance from buyers.
A simple process is projected as if it would require an involvement of lawyers etc. However, getting the sub-lease done is extremely simple process and does not always warrant involvement of lawyers. Home buyers can purchase stamp papers on their own and submit the same to builder. Builder should prepare the registration file and buyer can get the registration done by themselves.
Until 2013, these charges were paid in authorities office in cash and no receipt was issued to buyers. After a group of home buyers objected and created ruckus in authority’s office, same has been discontinued. However, builders invented this new terminology of admin/lawyer charges recently and have started demanding these charges as part of final payment.
What does the law says
Under U.P. Apartment Act 2010 and Noida Authority Builder Bylaws, it is mandatory for the builder to get the registration done. It is the duty of the developer to ensure apartments are registered as soon as the occupancy certificate is received.
Is it possible to do the sublease without builder’s lawyer?
This is not a very complex process and one can get the registry done with involvement of lawyers. Some of the Noida builder had refused to get the registration done unless Admin charges were paid, however, when confronted by home buyers association, they have started giving an option of self registration. What should home buyers do
In case builder doesn’t agree to facilitate self registration, home buyers groups/association must insist for the same. It is illegal for the builder to make it a pre-condition to offer possession.
